SUMMARY OF INCIDENT:

On September 12, 2017, at approximately 18:15 hours, Rutland Troopers stopped an operator on VT Route 7, in the town of Danby (VT), for operating while using a portable electronic device (cell phone). 

 

Troopers identified the operator as Robert W. Kosmalski, age 57, of Danby.  Kosmalski was found to be operating the motor vehicle under criminal suspension due to several DUI convictions.

 

Kosmalski was taken into custody and transported to the Rutland State Police Barracks for processing.  Kosmalski was later released on citation and ordered to appear in the Rutland County Superior Court/ Criminal Division on October 23, 2017, at 08:30 hours to answer to the above charge.
