SUMMARY OF INCIDENT:

 

On the above date and time the Vermont State Police responded to 773 Mud Hollow Rd. in the Town of Kirby for a reported dispute. On arrival, witnesses said Harold J. Marcy (54) of St. Johnsbury, VT was intoxicated and left in his vehicle prior to the arrival of the Vermont State Police. Marcy was located at his residence in St. Johnsbury. Investigation revealed Marcy was intoxicated at the time of operation. He provided a preliminary breath sample which resulted in a .208% BAC. Additionally, Marcy was in violation of his curfew set by pre-trial conditions of release and issued by the Caledonia Superior Court. Marcy was taken into custody, processed for DUI, and issued a citation to appear in Caledonia Superior Court at a later date.
