VIOLATION: DUI- Driving under the influence

SUMMARY OF INCIDENT: On March 19, 2017 at approximately 0645 hours VSP Williston Troopers were called to the Fernwood Manor Mobil Home Park in the town of Bolton for a car into a snowbank as well as reports of a male walking around the park asking residents for help removing it. Upon VSP arrival, Troopers found Jeffrey B. Smialek Jr. walking on East St. and learned that he was the operator of the car. Smialek exhibited signs of alcohol impairment while Troopers spoke with him. Smialek provided a PBT of .074% approximately one hour after operation. Smialek was subsequently taken into custody and processed for suspicion of DUI. Smialek's evidentiary breath results were sent to the VFL- Vermont Forensic Laboratory for a chemists relation back to his time of operation. On March 26, 2017 Smialek was booked for DUI and will be required to appear in Chittenden District Court on April 25, 2017. Smialek was also issued VCVC's for failing to maintain control T23 VSA Section 1081(a) $220  and 2 points as well as T18 4230(a) possession of marijuana civil $100. Troopers were assisted at the incident by Richmond P.D.
