SUMMARY OF CRASH:

On the above date and time, State Police came upon a vehicle that had gone off the road and was hit by a train.  The incident had not yet been called in or reported.  McGinley was traveling east on US Rte 2, in Middlesex  when he lost control of his vehicle and went a few feet off the side of the road.  While he was waiting for a tow truck, a freight train came through and side swiped McGinley's vehicle.  McGinley was still inside the vehicle at the time of the incident and was not injured.  The vehicle sustained moderate damage to the passenger side.  The freight train did not sustain any damage and continued on its way within a couple hours of the incident.  McGinley was found to be under the influence of alcohol.  He provided a PBT and the result was a BAC of .085%.  McGinley was arrested for suspicion of DUI.  He was transported to the Middlesex Barracks for processing and later released on a citation.  McGinley is schedule to appear in Washington County Superior Court - Criminal Division on 05/04/17.
