SUMMARY OF INCIDENT: On 01/13/17 at approximately 0040 hours, Vermont State

Police were dispatched to the area of Elm Street and Grandview Street,

Shaftsbury, for a vehicle off the road and into a lawn. Troopers arrived on

scene and began an investigation into the incident.

 

The operator of the vehicle, Jason Fleming, returned to the scene after calling

to report the incident. During the investigation, it was suspected Fleming was

under the influence of intoxicating liquor. Fleming was asked to perform field

sobriety exercises, during which he showed several clues. Fleming provided a

preliminary breath test of .178% BAC. Fleming was taken into custody for

processing. Fleming was later released with a citation to appear in Bennington

County Superior Court, Criminal Division to answer to the charge of DUI.
