On Saturday, November 19, 2016, at approximately 1009 hours, members of the Vermont State Police were notified of a single motor vehicle crash which occurred at the intersection of Hortonia Road and Old Ti Road, in the Town of Hubbardton, Vermont.

Investigation revealed 70 year old Brian F. Kenny was traveling on Old Ti Road, towards the intersection of Hortonia Road, when the brakes on his 2009 Honda Pilot gave out. Kenny's vehicle traveled through the intersection, across Hortonia Road, and off the roadway south of the eastbound lane of travel. Kenny's vehicle crashed into a tree where it came to rest. Kenny was transported to the Rutland Regional Medical Center for evaluation.

During the investigation Troopers learned that Kenny might have consumed alcohol prior to the crash. Troopers met with Kenny at the hospital and while interacting with him several signs of impairment were observed.

Kenny volunteered a preliminary breath sample which yielded a 0.090% BrAC from a partial sample. Kenny was processed for driving under the influence and provided a sample of his blood for analysis.

The Vermont State Police were assisted by the Hubbardton Fire Department, Fair Haven Rescue Squad, Castleton Police Department, and the Castleton Constable.
