SUMMARY OF INCIDENT:
On October 15, 2016, at approximately 0126 hours, Vermont State Police stopped to check on a vehicle parked along the side of Interstate Route 4 between Exit 4 and Exit 5 in the town of Castleton, Vermont. While conversing with the operator, identified as Dale P. Hayes a strong odor of marijuana was emanating from the vehicle, the operator presented with blood shot watery eyes. The operator consented to allow Troopers to search the vehicle where a criminal amount of marijuana was seized, as well as approximately 100 pills of a regulated narcotic and an open container of beer.
Hayes displayed signs of impairment and was screened for DUI. Hayes provided a preliminary breath test which resulted in 0.147% BrAC at 0215 hours. Hayes was arrested for the suspicion of DUI and transported to the Rutland Trooper Barracks for processing.
Hayes was processed and charged with DUI refusal, and later released on a citation to appear at Vermont Superior Court, Criminal Division on October 31, 2016 to answer to the charge of driving under the influence and above listed charges.
