VSP Arrest- Crash- DUI (Refusal) - Negligent Operation

SUMMARY OF CRASH:           
On September 18, 2016, at approximately 23:10 hours, Shaftsbury Troopers responded to a single motor vehicle crash on Dunham Ave, in the town of Shaftsbury, VT. 

Upon arrival, Troopers identified the operator as Rory S. Kilpatrick, age 19, of Shaftsbury, VT.  Kilpatrick sustained very minor injuries as a result.  The vehicle Kilpatrick was operating sustained heavy front-end damage. 
               
During further investigation, Troopers discovered Kilpatrick was operating west on Dunham Ave (gravel roadway) at a high rate of speed.  Kilpatrick failed to maintain control of his vehicle while rounding a curve in the roadway.  Kilpatrick loss of control of the vehicle, exited the roadway, and crashed into a large tree on the south side of Dunham Ave.  Kilpatrick was the sole occupant and no others were injured.  

While investigating the crash, Troopers suspected Kilpatrick to have been operating under the influence of alcohol.  Kilpatrick was subsequently taken into custody for suspicion of DUI and Careless and Negligent Operation.   Kilpatrick later provided a preliminary breath sample which indicated his BAC was .204 % - 2.5 times the legal limit. 

Kilpatrick was later processed at the Shaftsbury Barracks.  During processing, Kilpatrick refused to provide an evidentiary sample of breath. 

At the conclusion of processing, Kilpatrick was issued a citation ordering him to appear in the Bennington County Superior Court/ Criminal Division on October 3, 2016, at 08:15 hours to answer to the above charges.
