SUMMARY OF CRASH:  On 08/10/16 at approximately 0514 hours Troopers were called out for a reported ATV crash on East Mountain Road in the town of Guilford.  Investigation revealed that OP#1 had been traveling east on East Mountain Road when he lost control of his ATV on a downgrade involving a sweeping right hand curve at approximately 0100 to 0130 hours.  The ATV rolled over, ejecting OP#1 from the vehicle.  OP#1 tried to use his cell phone to call for help, but it was not functioning.  At approximately 0500 hours a passerby stopped and assisted OP#1 by letting him use his cell phone.  OP#1 contacted 911 which resulted in Guilford Fire/Rescue, Rescue Inc. and the State Police being dispatched.  OP#1 was transported to BMH by Rescue Inc. with what appeared to be minor injuries.  OP#1 was found to have suffered several cervical fractures as a result of the crash and he was later transferred to DHMC via Rescue Inc. ambulance.

 

During the interview of OP#1 at BMH, it was determined that he’d been drinking.  An Alco-Sensor test administered at approximately 0622 hours resulted in a .197% BAC.  A search warrant was obtained and an evidentiary blood sample was obtained from OP#1 prior to his transfer to DHMC.  OP#1 was cited to appear in Windham Superior Court-Criminal Division on 09/27/16 to face the charge of DUI.  He was also issued Diversion paperwork for being a minor who had consumed alcohol.
